The Notices below are included in the paperwork offered when initiating services with this practice and describe the policies and terms that govern services and communications with this practice.

SMS/Text Messaging Terms of Service

The Practice of Cheryl O. Hart, PsyD (“the Practice”) may communicate with clients via SMS/text messaging for administrative and customer care purposes. The Practice does not send promotional marketing messages via SMS. Consent to receive SMS messages is completely optional and not a condition of purchase or of receiving healthcare services. By opting into SMS/text messaging from the Practice through your patient portal, verbal request, or other communication method, you agree to receive SMS text messages from the Practice.

These messages may include customer care and administrative communications related to your services.

SMS/Text Messaging Informed Consent

By signing this form, I consent to receive SMS text messages (SMS and/or MMS) from The Practice of Cheryl O. Hart, PsyD at the mobile phone number I have provided. I understand that text messaging is used for administrative purposes only and is not used for therapeutic communication or clinical intervention.s - these messages may include:

  • Appointment reminders and confirmations

  • Scheduling updates or changes

  • Billing and payment notifications

  • Limited care coordination communications

  • Administrative messages related to services

Acknowledgement of Understanding

Voluntary Participation

My consent to receive text messages is voluntary. I understand that I may receive services from the Practice even if I decline SMS communication.

Message Frequency

Message frequency will vary depending on my care and administrative needs.

Message and Data Rates

Message and data rates may apply depending on my mobile carrier and service plan.

Opt-Out Rights

I may withdraw consent to receive text messages at any time by Replying STOP to any message, or contacting the Practice to opt out. Opt-out requests will be honored within a reasonable timeframe. After opting out, I will no longer receive SMS communications unless I provide new consent.

Accuracy of Phone Number

I certify that the mobile phone number I provide belongs to me. I agree to notify the Practice if my phone number changes or is reassigned.

Privacy, Security, and HIPAA

The Practice takes reasonable steps to protect client privacy and comply with HIPAA. However, I understand:

  • Standard SMS text messaging is not encrypted and may not be fully secure

  • There is a risk that protected health information (PHI) could be accessed if my phone is lost, stolen, shared, or accessed by others

  • SMS communications may be transmitted through RingCentral and ICANotes - HIPAA-capable third-party practice administration platforms used by this Practice.

The Practice will limit the amount of personal or health information shared via text and will not transmit full clinical records or highly sensitive information by SMS.

The Practice does not sell, rent, or share mobile phone numbers with third parties for marketing purposes.

Content of Messages

I authorize the Practice to include limited personal or health-related information in text messages when reasonably necessary for administrative or care coordination purposes, such as:

  • Appointment date, time, or location

  • Billing reminders

  • Basic administrative notifications

  • Responses to my questions/requests

Text messaging is intended for administrative communication only and is not a substitute for therapy or clinical care.

Not for Emergencies

Text messaging is not a secure or immediate form of communication and must not be used for urgent or emergency mental health or medical concerns. We recommend that clients experiencing an emergency:

  • Call 911

  • Go to the nearest hospital emergency room

  • Contact a crisis hotline or appropriate emergency resource (see Emergency/Crisis Instruction)
